1. Introduction

SPERANZA is an online marketplace where users can book unique experiences provided by independent service providers. By accessing or using our platform, you agree to these Terms and Conditions. If you do not agree, please do not use our services.

2. Service Description

SPERANZA facilitates the booking of experiences offered by independent service providers. While we do vet experiences and “experience curators”, we do not control or guarantee the quality, timing, legality, or any other aspect of the experiences provided. SPERANZA’s role is solely to connect users with independent service providers and facilitate the booking process.

3. User Obligations

When booking an experience through SPERANZA, you agree to provide accurate information and comply with any additional terms and conditions set by the independent service providers.

4. Independent Service Provider (Experience Curator) Obligations

Independent service providers are responsible for delivering the experience as described on the platform. They must respond promptly to booking requests and fulfill the experience within 6 months of the user’s initial attempt to schedule it. Failure to do so may result in penalties, including the reimbursement of any refunds issued to users by SPERANZA.

5. Cancellation and Refund Policy

All sales of experiences are final. Once a booking is made, it cannot be canceled, and no refunds will be provided except in special circumstances or as required by law. If an independent service providers fails to fulfill the experience within 6 months despite the user’s efforts to schedule it, SPERANZA reserves the right to issue a full refund to the user, with the independent service providers responsible for reimbursing SPERANZA for any such refunds.

7. Liability and Insurance

Independent service providers are solely responsible for obtaining any necessary insurance coverage for their services and assume all liability for any accidents, damages, or injuries arising from the provision of the experience. SPERANZA bears no responsibility for any issues or liabilities that arise during or as a result of the experience.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

9. Miscellaneous

  • Force Majeure: SPERANZA shall not be liable for any failure to perform its obligations under this agreement due to unforeseen circumstances or events beyond its control.

  • Severability: If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will remain in full force and effect.

By using SPERANZA, whether you create an account or book as a guest, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
